General terms and conditions of business

1. Scope of application

For all orders via our online shop by consumers and entrepreneurs the following terms and conditions apply.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity. Entrepreneur is a natural or legal person or a partnership with legal capacity, which acts in exercise of its commercial or independent professional activity when concluding a legal transaction.

The following applies to entrepreneurs: If the entrepreneur uses conflicting or supplementary General Terms and Conditions of Business, their validity is hereby objected to; they only become part of the contract if we have expressly agreed to them.

2. Contracting party, conclusion of contract

The purchase contract is concluded with Sim-Motion Inc.

By placing the products in the online shop we make a binding offer to conclude a contract for these articles. You can place our products in the shopping cart without obligation at first and correct your entries at any time before sending your binding order by using the correction aids provided and explained in the order process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after sending the order you will receive another confirmation by e-mail.

3. Contract language, contract text storage

The languages available for the conclusion of the contract are in English.

We save the text of the contract and send you the order data and our terms and conditions by e-mail. You can view the contract text in our customer login.

4. Terms of delivery

Shipping costs are added to the stated product prices. You can find out more about the amount of the shipping costs in the offers.

We deliver by Fed Ex, UPS or USPS. It is also possible to pick up the goods yourself.

*Canadian Duties and Taxes are not covered, you will be responsible for all charges*

5. Payment

In our shop, the following payment methods are available to you:

Credit card
When you place your order, you simultaneously send us your credit card details. After your legitimation as a legitimate cardholder, we request your credit card company to initiate the payment transaction immediately after the order. The payment transaction is automatically carried out by the credit card company and your card is charged.

PayPal
During the ordering process you will be redirected to the website of the online provider PayPal. In order to pay the invoice amount via PayPal, you must be registered there or first register, authenticate with your access data and confirm the payment order to us. After placing the order in the shop, we will ask PayPal to initiate the payment transaction. The payment transaction will be carried out automatically by PayPal immediately afterwards. You will receive further instructions during the ordering process.

Affirm
Affirm grants you the possibility of making payments over time on approved credit through Affirm. 

6. Order Cancellation

We only allow orders that have not shipped yet to be canceled. To cancel an order please contact us with your full name, order ID, reason for canceling, and the part or parts you want to cancel. A $10.00 fee will apply to order cancellations due to payment processing companies take a percentage for processing an order and again for processing a refund. Therefore, if you want to cancel there is a fee to cover those processing charges, for our time to process and do the accounting work.

We believe this is fair since we begin working on your order the moment the Place Order button is clicked. We pay our staff to process orders and allocate inventory for these orders. If you are unsure about an item please contact us or conduct the research you need to be sure it is what you want or need. There is no exception this fee on cancellations.

7. Transport damage

The following applies to consumers: If goods with obvious transport damage are delivered, please complain about such defects to the delivery agent as soon as possible and contact us immediately or refuse delivery. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, especially your warranty rights. However, you help us to be able to assert our own claims against the carrier or the transport insurance company.

8. Warranty and guarantees

All products have a One Year Warranty and are guaranteed to be free of defect. If you have a warranty issue, contact us at support@sim-motion.com to process your warranty or defect claim.
